These terms are a contract between you (the customer) and Michael Nitschke Pty Ltd (ACN 670 021 075) as trustee for the Michael Nitschke Trust (ABN 11 982 538 704) ("we", "us", "our"). They cover your use of mn-os ("the service"), available at app.michaelnitschke.com.au. By signing up or using the service you agree to them. If you don't agree, don't use it.
mn-os is a cloud-hosted operating system for real estate principals. It covers weekly meeting agendas, issues logs, quarterly priorities, numbers and metrics tracking, hiring pipelines, org charts, playbooks, people profiles, and related tools. You create a workspace ("tenant") and can invite team members. You are responsible for the actions of anyone you invite.
Prices are exclusive of GST. GST is added at checkout where applicable. You choose your plan at checkout. Billing is handled by Stripe. There is no free trial. We may change prices from time to time; any change will apply from your next renewal and we will give you reasonable notice.
You can cancel at any time from your account settings. Cancellation stops future charges. We do not refund unused portions of a monthly or annual period, except where a refund is required by the Australian Consumer Law. Your workspace stays accessible until the end of the period you have paid for.
Everything you put into your workspace (notes, issues, quarterly priorities, people profiles, numbers, playbook entries, and anything else) belongs to you. You grant us a limited, non-exclusive licence to store, display, process, and back up that content only to the extent needed to run the service for you.

The service itself, including its code, brand, name, page layouts, structure, prompts, and terminology, is our intellectual property. You may not copy, reverse engineer, resell, or build a competing product from it.
If you send us feedback, feature requests, or ideas, that feedback is non-confidential. We may use it to improve the service without any obligation to you.
Our authorised representatives may log into your account to provide support and training.
Don't use the service for anything illegal. Don't try to access other tenants' data, probe the service for vulnerabilities, or upload content you don't have the right to store. We may suspend or close accounts that break these rules.
We aim for high availability but do not guarantee uninterrupted service. Subject to the next paragraph, the service is provided "as is" and without warranties of any kind.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other law that cannot lawfully be excluded, restricted, or modified.
To the maximum extent permitted by law, we are not liable to you for any indirect, incidental, consequential, or special loss, including lost revenue, lost profits, lost opportunities, or loss of data.
Where our liability cannot be excluded but can be limited, and to the extent permitted by law, our total liability to you for any claim under or in connection with these terms is capped at the fees you have paid us in the 12 months before the claim arose. This cap does not apply to any liability we cannot lawfully limit, including liability for a breach of a non-excludable consumer guarantee under the Australian Consumer Law.
We may update these terms from time to time. When we do, we will update the version date at the top of this page and notify you in the service. If you keep using the service after the change takes effect, you accept the updated terms.
These terms are governed by the laws of South Australia, Australia. Both parties submit to the non-exclusive jurisdiction of the courts of that state.
